Abstract

RESUMEN: Se desarrolló una investigación cualitativa, para analizar la perspectiva Constitucional y Derechos Humanos referente al Plan de Control Territorial. Asimismo, utilizamos los métodos científicos, analítico, sintético, deductivo y como fuente doctrinal el neo- constitucionalismo y post- positivismo, además se describió el contenido de la política criminal y las teorías de las representaciones sociales y su influencia en la modernidad, como en el constitucionalismo moderno, donde los derechos humanos y derechos fundamentales exigen que la institucionalidad active el sistema de protección jurisdiccional estatal ante el exceso de poder. También se utilizó la técnica de entrevistas no estructuradas, dirigidas a Criminólogos, instituciones como la Procuraduría de Derechos Humanos, constitucionalista, magistrados y colaboradores de la sala de lo Constitucional El Salvador, con el objetivo de recolectar datos, que concluyen que el Plan Control Territorial debe siempre tener una visión constitucional y respetar los derechos humanos, porque el poder del Estado debe ser limitado y debe prevalecer la prevención por medio de programas sociales que fortalezcan los factores de cooperación. ABSTRACT: A qualitative research was developed to analyze the Constitutional Perspective and Human Rights regarding the Territorial Control Plan. We also used scientific, analytical, synthetic, deductive methods and neo-constitutionalism and post-positivism as a doctrinal source, in addition, the content of criminal policy and theories of social representations and their influence on modernity were described, as in modern constitutionalism, where human rights and fundamental rights require that the institutions activate the state jurisdictional protection system in the face of excess power. The technique of unstructured interviews was also used, aimed at Criminologists, institutions such as the Human Rights Ombudsman, constitutionalist, magistrates and collaborators of the El Salvador Constitutional Chamber, with the aim of collecting data, which conclude that the territorial control plan it must always have a constitutional vision and respect human rights because the power of the state must be limited and prevention must prevail through social programs that strengthen cooperation factors
